AES UK LTD User Agreement

1. General Provisions

This User Agreement (hereinafter the “Agreement”) governs the relationship between TOKEMY.CH (hereinafter “TOKEMY.CH”, “we”, “us” or “our”) and any individual who registers and uses the TOKEMY.CH platform (hereinafter the “User”). By registering and using the platform, the User fully and unconditionally accepts the terms of this Agreement.

If the User does not agree with these terms, they must immediately cease using the Service.

No intellectual property rights are transferred to the User under any circumstances.

2. Definitions

User: Any individual of legal age accessing and using the platform service: The TOKEMY.CH platform, including all technical and functional infrastructure Services: Digital asset services including crypto swap execution and related functionalities

• Subscription: Access to specific platform features, where applicable
• Personal Account (PA): Secure user area accessible via login credentials

Order: User request to access or use specific Services

3. Subject of the Agreement

Under this Agreement, TOKEMY.CH grants the User access to its platform and services according to the selected features and conditions.

The platform provides:

Crypto-to-crypto swap functionalities Wallet interaction (non-custodial integration) Non custodial wallett private key 

Transaction monitoring and history Access to digital asset tools and infrastructure

The User is solely responsible for how they use the Service.

4. Registration

To access the Service, the User must create an account by providing accurate information.

The User is responsible for:

• Maintaining the confidentiality of login credentials
• All activities conducted through their account

TOKEMY.CH is not liable for unauthorized access due to user negligence.

5. Use of Services

The User may:

Access platform functionalities

• Execute crypto transactions
• Monitor balances and activity
• All actions are performed independently by the User without direct involvement of TOKEMY.CH.

6. Financial Terms

Fees are defined and may be updated at any time Payments are processed via supported systems Transactions are executed at the User’s own risk TOKEMY.CH does not guarantee profits or financial outcomes.

7. Compliance and Verification

TOKEMY.CH reserves the right to:

• Request identity verification (KYC)
• Request proof of funds origin
• Restrict or suspend accounts in case of suspicious activity
• Failure to comply may result in account limitations or termination.

8. Rights and Obligations

TOKEMY.CH undertakes to:

• Provide access to the platform
• Maintain operational functionality
• Ensure reasonable security measures

TOKEMY.CH has the right to:

• Modify the Agreement at any time
• Suspend or terminate services
• Restrict access in case of violations

The User undertakes to:

• Provide accurate information
• Use the platform lawfully
• Not attempt unauthorized access
• Not misuse or exploit the platform

9. Disclaimer

TOKEMY.CH does not provide financial, legal, or investment advice. All services are provided “as is”

Users operate at their own risk

TOKEMY.CH is not responsible for:

• Market losses
• User decisions
• Third-party failures
• Technical interruptions
• 10. Limitation of Liability

TOKEMY.CH shall not be liable for:

• Direct or indirect financial losses
• Loss of data or profits
• Business interruption
• External attacks or system failures

11. Dispute Resolution

Disputes shall first be resolved amicably.

If unresolved:

Governing law: United Kingdom

Jurisdiction: competent courts under UK law

12. Duration and Termination

This Agreement: Enters into force upon user registration Remains valid until termination

TOKEMY.CH may terminate access: Immediately Without prior notice In case of any criminal  violations.

13. Intellectual Property

All rights related to:

• Platform
• Software
• Branding
• Technology

are owned exclusively by TOKEMY.CH. Unauthorized use is strictly prohibited.

14. Additional Provisions

Services may be temporarily unavailable for maintenanceTOKEMY.CH may assign rights to third parties

Continued use implies acceptance of updates
